AMENDMENTS
eKhokhar.com may amend/modify these Terms and Conditions at any time, and such modifications shall be effective immediately upon posting of the modified Terms and Conditions on our website. You may review the modified Terms and Conditions periodically to be aware of such modifications and your continued access or use of our website, shall be deemed conclusive proof of your acceptance of these Terms and Conditions, as amended/modified from time to time.

In a case of use of our website in a manner inconsistent with these Terms and Conditions, we may terminate your access, block your future access and/or seek such additional relief as the circumstances of your Misuse may be deemed to be fit and proper.

DEFINITIONS
The term “Misuse” shall mean and include all acts which are aimed at utilizing our website for any purposes other than for searching and advertising for genuine job vacancies.

The term “offensive material” shall mean and include obscene material as defined in Section 67 of the Information Technology Act of India, 2000. It shall include content which is aimed at demeaning a particular class of individuals, corporate body, country etc. It shall also include content having the effect of violating the intellectual property rights of others.

The term “Spam” or “Spamming” shall mean and include any unsolicited bulk e-mail or unsolicited commercial e-mail or indiscriminately uploading/relaying content on/through the networks of our mail server.

The term “Subscriber” would include any person, whether an individual or a legal entity who has subscribed to the Services of eKhokhar.com, and to whom the access is restricted by the use of a sign in user name and a password. The user name and password are either allotted by us or chosen by the user or agreed upon by our management.

The term “Unauthorised User” is defined as any person who does not have a legal or a contractual right to access the Services of our website but does so.

USER'S REGISTRATION OBLIGATIONS

When an applicant chooses to respond to a vacancy which has been advertised on our website, the applicant consents to us at the time job data collection, storage, and use, in accordance with in his/her job application. Such applicant understands that his/her personal data will be available to the advertiser/Employer.

THE USER REPRESENTS, WARRANTS AND COVENANTS THAT ITS USE OF THE SERVICES OF OUR WEBSITE NOT BE DONE IN A MANNER SO AS TO:

By accessing eKhokhar.com, you agree that the laws prevailing in India shall be the governing laws in all matters relating to us as well as these Terms and Conditions.

Courts at Ahmedabad, India shall have the exclusive jurisdiction in all matters relating to us and these Terms and Conditions, irrespective of the territory and jurisdiction of your access to our website.

eKhokhar.com reserves all other rights.

JobSeekers:

By sending a response to a job listing, you agree to the following:
1. You indicate your interest in the Job Listing using the Services, you are sending your CV and application information including relevant documents to advertiser and you are requesting and authorizing advertiser to make available such application information to the applicable Employer(s) for such Job Listing(s).
2. You also agree that eKhokhar.com is not responsible for the content of the Employer’s application form, messages, screener questions, testing assessments; required documents, or their format or method of delivery.
3. You consent to your application, documents and any responses sent to you by the Employer or vice versa through the networks of us being processed and analysed by eKhokhar team according to these terms of use. The resume/ insertion or eKhokhar.com neither guarantees nor warranties that there would be a satisfactory response or any response at all once the resume / insertion or information/data is fed by the User.
4. This Service entitles the User alone to add, modify or change the data/information fed in by him/her but does not entitle him/her to use the service to feed fresh insertion or information/data /resume of another person in place of the insertion or information/data already fed in by such User.
5. The username/password created by the Subscriber will enable the Subscriber to access all the information received through eKhokhar.com, but the sole responsibility of the safe custody of the password shall be that of the Subscriber.
6. You agree that you may be contacted via email, telephone and/or post by the advertiser of the job listing, for position applied for or for any similar position arising in future and eKhokhar.com will not be held responsible for contacts/mails received by you from the advertiser.
Solutions from Recruitment

1. The Subscriber will comply with all applicable data protection laws in relation to the processing of personal data; and not process personal data in an unlawful manner and excessive with regard to agreed purposes as defined in the privacy policy and these terms and conditions.
2. The Subscriber agrees to provide reasonable assistance as is necessary to facilitate the handling of any Data Security Breach (as relevant under privacy laws applicable) in an expeditious and compliant manner.
3. The Subscriber agrees that the responsibility for complying with a data subject /data principal request lies with the Party which holds/processes the Personal Data collected/shared.
4. The Subscriber shall retain or process shared Personal Data for no longer than is necessary to carry out the agreed purposes.
5. The Subscriber shall act as an independent Data Controller in respect of shared personal data obtained on using the Services and once the data is collected by the Subscriber and the Subscriber shall be responsible for its secure use at all times.
6. eKhokhar.com shall in no way be held liable for any information received by the Subscriber and it shall be the sole responsibility of the Subscriber to check, authenticate and verify the information/response received at its own cost and expense.
7. eKhokhar.com will commence providing services only upon receipt of amount/charges upfront either from the Subscriber or from a third party on behalf of the Subscriber.
8. The Subscriber/recruiter shall be assigned a password (s) by eKhokhar.com to enable the Subscriber to access all the information received through the software, but the sole responsibility of the safe custody of the password shall be that of the Subscriber and eKhokhar.com shall not be responsible for data loss/theft of data/corruption of data or misuse of the password and any damage or leak of information and its consequential usage by a third party. eKhokhar.com undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the Subscriber.
